U.S. District Judge Jacob asked the Department of Justice to submit another brief by Thursday to oppose Cook's request to take immediate court action to prevent the Federal Reserve from executing the dismissal order. According to judicial procedures, judges usually have to wait until all documents are submitted before making a ruling. Judge Jacob held a hearing on August 29. Cook's lawyers argued that if an agreement cannot be reached with the government to ensure that he continues to perform his duties during the litigation, the judge will need to make a temporary ruling to maintain the status quo as soon as possible.
