Odaily News The Trump Terms and Conditions page states: “THIS AGREEMENT CONTAINS DISCLAIMERS, LIMITATIONS OF LIABILITY, RELEASES, CLASS ACTION WAIVER, AND REQUIREMENTS FOR ARBITRATION OF ANY AND ALL CLAIMS ARISING UNDER THIS AGREEMENT AGAINST FIGHT FIGHT LLC, ITS AFFILIATES, MANAGERS, MEMBERS, SERVICE PROVIDERS, PARTNERS, CONSULTANTS AND SUPPLIERS (COLLECTIVELY, THE ‘INDEMNIFIED PARTIES’), WHO ARE THE EXPRESS THIRD-PARTY BENEFICIARIES OF THE MANDATORY ARBITRATION PROVISION. THE FOREGOING PROVISIONS ARE A FUNDAMENTAL FOUNDATION OF THIS AGREEMENT.”
The Class Action Waiver clause reads: "To the extent permitted by law, you agree not to initiate, join or participate in any class action lawsuit regarding any claim, dispute or controversy you may have against any Insured Party. You consent to injunctive relief to stop such action or to disqualify you as a participant in such action. You agree to pay the attorneys' fees and litigation costs incurred by any Insured Party in seeking such relief. This provision preventing you from initiating, joining or participating in a class action lawsuit: (i) does not constitute a waiver of any right or remedy you may have to bring a claim individually and not as a class in binding arbitration as set forth above; and (ii) is an independent agreement. You may opt out of these dispute resolution provisions by providing written notice of your decision within thirty (30) days of the date you first access the Site."
