Min Byung-deok, a senior member of the policy committee of South Korea's ruling Democratic Party, said that crypto taxation should only begin after the passage of the Digital Asset Basic Act, and that it is inappropriate to start levying taxes before the foundational law is in place. He noted that difficulties in tracking income from overseas trading platforms and the inability to carry over investment losses reflect that tax administration conditions are not yet mature.
The South Korean government still insists on implementing the virtual asset income tax on schedule. Finance Minister Lee Hyung-il stated that the current tax law provides for taxation of virtual asset income starting next year; about 85% of investors hold less than 5 million Korean won, and after deducting the 2.5 million Korean won basic exemption, most investors will either owe no tax or face a low tax burden. Under current rules, income from the transfer or lending of virtual assets is taxed at a 20% rate on annual net gains, losses cannot be carried forward, and the actual filing and payment window is expected to open in May 2028.
