Four CFTC commissioner nominees have cleared White House review, filling vacancies could become bargaining chip in CLARITY Act negotiations

Odaily News: According to three sources familiar with the matter, the White House has reviewed potential candidates for four vacant commissioner seats at the CFTC, though it remains uncertain when or whether formal nominations will be made. Currently, the CFTC has only one commissioner, Chairman Michael Selig, whereas the agency is typically composed of five bipartisan commissioners.

The vacant commissioner seats have become a point of contention in CLARITY Act negotiations. Democratic lawmakers argue that at a time when the bill seeks to expand and delineate the regulatory authority of the SEC and CFTC over digital assets, both agencies are facing significant vacancies. The Senate is expected to hold a key procedural vote on the CLARITY Act on September 15. Sources familiar with the matter stated that a White House commitment to fill CFTC vacancies could serve as one of the conditions to secure Democratic support. Even if the bill advances in the Senate, due to the fall congressional session and midterm election schedule, the legislation could still be delayed until the lame-duck session following the November elections.
