Investment bank TD Cowen stated that there is a 75% chance the bill will not become law this fall, with the next procedural vote in the U.S. Senate expected to take place on September 15.
The CLARITY Act aims to place regulatory authority over digital commodities with the U.S. Commodity Futures Trading Commission (CFTC), while assets classified as investment contracts would continue to be overseen by the U.S. Securities and Exchange Commission (SEC). Senators are divided over revisions to ethics rules, the Bank Secrecy Act, and anti-money laundering requirements.
TD Cowen outlined three scenarios in which the bill could fail, including the September procedural vote not taking place, the bill advancing past the initial vote but stalling thereafter, and disputes over amendments leading to obstruction of a motion to end debate.
