Odaily Planet Daily News: The U.S. Ninth Circuit Court of Appeals has denied requests by Kalshi and Polymarket to halt enforcement lawsuits filed by the states of Nevada and Washington against their prediction market operations. The cases will continue to be heard in state courts. A panel of three federal judges ruled that the two companies failed to demonstrate that defending in state court would cause irreparable harm, nor did they sufficiently establish that the federal courts have "federal question jurisdiction" over the cases. The court noted that the states' allegations, primarily based on state law, accuse the companies of operating without a license and engaging in suspected illegal gambling. The federal preemption arguments raised by Kalshi and Polymarket are merely defensive claims and cannot independently constitute a basis for federal jurisdiction. The court emphasized that principles of federalism and comity support allowing states to enforce their gaming and regulatory laws in their own state courts.
