Opinion: The US Supreme Court tariff case outcome may have limited economic impact.
2025-11-05 22:25

Odaily Planet Daily reports that the U.S. Supreme Court is currently deliberating whether the International Economic Emergency Act (IEEPA) grants the president the power to impose tariffs to guide economic activity when an emergency is deemed necessary. However, a recent Brookings Institution article points out that regardless of the court's final ruling, the actual economic impact may be limited. "Even if the Supreme Court upholds a lower court's previous ruling against Trump, it is still likely to have sufficient authority under other trade laws to reimpose tariffs similar to those under IEEPA in the future, although some procedural obstacles may be encountered." If the court rules that the president has no authority to impose tariffs under IEEPA, the biggest economic consequence could be that the government has to refund the more than $100 billion in tariffs already collected.
