Opinion: The US SEC ended its investigation into Ethereum to avoid litigation

Teresa Goody Guillén, a partner at BakerHostetler and a former SEC litigation attorney, told CoinDesk that this does not mean that the Commission definitely believes that Ethereum is not a security, but it does provide another data point that the Commission has concluded that it will not file a lawsuit alleging that Ethereum is a security at this time. A former SEC enforcement attorney who wished to remain anonymous said that the SECs decision to abandon the investigation may be because the risk of litigation borne by the agency was too great. He said: I think the important thing to remember is that I dont think the closure of the case necessarily means that they have decided that this is not a security. They may have just decided that they dont want to risk filing a lawsuit.
