In a filing submitted to the U.S. Court of Appeals for the Second Circuit late last Friday, SBF's lawyer argued that SBF was merely exercising its First Amendment rights by sharing private documents of his former colleague and lover, Caroline Ellison, with a New York Times reporter. The intention was to defend his own reputation, not to intimidate.
Prosecutors argued that SBF's actions constituted harassment towards Ellison and were intended to prevent others from testifying. (Reuters)
Yesterday, SBF's lawyer filed another motion for temporary release, citing similar reasons as before, including poor internet conditions in prison and insufficient laptop power. The bottom line request is to allow SBF to meet with the defense team five times a week to help with trial preparation.
