They emphasize that prediction markets should be uniformly regulated by the CFTC at the federal level, rather than being categorized as gambling by individual states. They also recommend that the CFTC adopt an interpretation based on the settlement asset to determine whether a contract involves sensitive areas such as war or gambling, and that upon the conclusion of its review, the CFTC should publicly disclose its full reasoning for either approving or denying a contract.
