美CFTC承认2022年对Gemini诉讼“不应提起”,双方联合申请撤销判决
Odaily Planet Daily News: The U.S. Commodity Futures Trading Commission (CFTC) announced that it has jointly filed with Gemini a motion for exemption from judgment in the 2022 case against Gemini Trust Company LLC.
Reportedly, the case was filed in June 2022, and the two parties reached a settlement agreement in January 2025. After a comprehensive review, the CFTC concluded that the case should not have been brought and would not have been filed under current enforcement standards.
The review report points out six major issues, including: the lawsuit was primarily based on statements from a known whistleblower lacking credibility; the investigation targeted Gemini, the victim, rather than focusing on the alleged fraudsters; the strength of the evidence against Gemini was questionable; key evidence was not provided to the commissioners during voting; litigation attorneys used deliberative privilege to prevent Gemini from accessing defense materials; and relevant personnel allegedly used regulatory power to pressure Gemini into a settlement.
