OpenAI lawsuit continues, Sam Altman to testify in court

2026-05-12 14:29

Odaily Planet Daily News At the U.S. District Court in Oakland, California, Sam Altman, CEO of OpenAI and one of the key witnesses in the closely watched lawsuit, is expected to testify in court today.

The lawsuit, filed by Elon Musk in 2024, accuses OpenAI and its management of violating their non-profit mission commitments and questions whether their transition to a commercial structure involved breaches of charitable fiduciary duties.

During the trial, OpenAI Board Chair Bret Taylor continued his testimony, stating that the company was "on the verge of collapse" during the management turmoil in 2023, and noted that the current restructured framework is clearer, though the non-profit entity still retains control.

Meanwhile, Satya Nadella stated in his testimony that Microsoft "took on significant risk when no one else was willing to bet" by investing over $13 billion in OpenAI in 2019, and claimed he had never received any formal challenge from Musk regarding the compliance of the investment.

The case continues to center on the legality of OpenAI's transition from a non-profit organization to a commercial structure, with Altman's testimony seen as a key moment in this phase of the trial. (CNBC)
