OpenAI trial continues, Sam Altman to testify in court

2026-05-12 14:29

Odaily Planet Daily News At the ongoing OpenAI-related trial in the U.S. District Court for the Northern District of California in Oakland, one of the highly anticipated key witnesses, OpenAI CEO Sam Altman, is expected to testify in court today.

The case, filed by Elon Musk in 2024, accuses OpenAI and its management of violating their non-profit mission commitments and questions whether their transition to a commercial structure involved breaches of charitable fiduciary duties.

During the trial, OpenAI Board Chair Bret Taylor continued his testimony, stating that the company was "nearly on the verge of collapse" during the management turmoil in 2023. He noted that the restructured organization is now clearer but that the non-profit entity still retains control.

Meanwhile, Satya Nadella stated in his deposition that when Microsoft invested over $13 billion in OpenAI in 2019, it "took on significant risk when no one else was willing to bet on them," adding that he had never received any formal challenge from Musk regarding the investment's compliance.

The case continues to center on the legality of OpenAI's transition from a non-profit organization to a commercial structure. Altman's testimony is seen as a pivotal moment in the current phase of the trial. (CNBC)
