Green United promoters appeal SEC's crypto mining scam case

Odaily News Kristoffer Krohn, a promoter of Green United, who has been accused of participating in an $18 million cryptocurrency mining fraud scheme, is trying to appeal his case, arguing that the U.S. Securities and Exchange Commission (SEC) should be forced to drop the lawsuit because its allegations that he was involved in the sale of securities were false. On October 24, Kristoffer Krohn told the Utah federal court that the Tenth Circuit Court of Appeals should decide whether buyers of the company's equipment mean that they have joined a "common enterprise," which the SEC used to accuse the company of selling investment contracts under securities laws. "The SEC does not and cannot accuse Green Box purchasers of having any rights or interests in the profits of Green United's business operations," Krohn said in the appeal. If the appeal is successful, Krohn will be allowed to defend his case before a three-judge appellate panel, a process that could take months to make a final decision. Earlier in September, Green United failed to dismiss the $18 million crypto mining fraud lawsuit filed by the SEC against it. (Cointelegraph)
