OpenAI lawsuit continues trial, Sam Altman to testify in court

2026-05-12 14:29

Odaily Planet Daily News At the ongoing OpenAI-related trial in the U.S. District Court for the Northern District of California in Oakland, one of the highly anticipated key witnesses, OpenAI CEO Sam Altman, is expected to testify today.

The case was initiated by Elon Musk in 2024, accusing OpenAI and its management of violating their non-profit mission commitments and questioning whether their transition to a commercial structure involved breaches of charitable fiduciary duties.

During the trial, OpenAI board chairman Bret Taylor continued to testify, stating that the company "was on the brink of collapse" amid management turmoil in 2023. He noted that the restructured framework is now clearer, but the non-profit entity still retains control.

Meanwhile, Satya Nadella stated in his testimony that when Microsoft invested over $13 billion in OpenAI in 2019, it "took on significant risk when no one else was willing to bet." He also said he had never received any formal challenge from Musk regarding the compliance of the investment.

The case continues to focus on the legality of OpenAI's transformation from a non-profit organization to a commercial structure, with Altman's testimony seen as a pivotal moment in this phase of the trial. (CNBC)
