OpenAI Lawsuit: Microsoft CEO Testifies in Court, Altman and Musk Controversy Spreads to Core Relationships of AI Giants

2026-05-11 16:29

According to Odaily, during the OpenAI lawsuit, Satya Nadella, CEO of Microsoft, testified in the U.S. District Court in Oakland, California. The case revolves around the escalating legal disputes concerning OpenAI's non-profit structure and its commercialization path. The lawsuit, filed by Elon Musk in 2024, accuses Microsoft of "aiding and abetting the breach of charitable fiduciary duties" during OpenAI's transition from a non-profit to a commercial entity. Since 2019, Microsoft has made continuous strategic investments in OpenAI, with total investments reaching approximately $13 billion by 2023, making it one of OpenAI's most crucial external backers.

During the trial, Satya Nadella reviewed the early partnership between Microsoft and OpenAI, mentioning that the two entities had established deep technical and computing cooperation before the launch of ChatGPT. Musk, in his prior testimony, stated that Microsoft's additional $10 billion investment in OpenAI in 2023 was a key trigger for his decision to file the lawsuit, arguing that the scale of the investment altered OpenAI's original non-profit-oriented structure. "We are concerned they are turning a charitable organization into a commercial tool," Musk stated in court. He also questioned Microsoft's potential dominant position in the development of Artificial General Intelligence (AGI), noting that its deep ties with OpenAI could impact the competitive landscape of the industry.

The case is still ongoing, and the debate surrounding OpenAI's governance structure, its non-profit status, and control over the AI industry is expected to continue. (CNBC)
