Pham, Acting Chair of the U.S. Commodity Futures Trading Commission (CFTC), expressed support for the Department of Justice’s announcement to end its policy of regulating the crypto asset industry through prosecution, and instructed the CFTC not to bring lawsuits in digital asset-related cases for violating the registration provisions of the Commodity Exchange Act when the defendant lacks subjective intent.
In addition, she has restructured the enforcement division to promote rapid resolution of compliance backlogs that do not involve customer harm or market abuse.
